General Conditions of Entry

Please read these General Conditions of Entry before applying to enter the TCS London Marathon MyWay – they contain important information about Your safety and wellbeing.

In these Conditions of Entry, the following definitions shall apply:

"Agreement": the agreement between you and LMEL comprised of these Conditions of Entry and any other terms and conditions applicable to the Event as required by LMEL from time to time;

“App”: the mobile application for the Event which shall be released by LMEL in advance of the Event Date(s);

“Charity”: a charity registered in the United Kingdom or the United States of America. “Charities” shall be construed accordingly;

"Data Protection Legislation": means the UK GDPR (which merges the Data Protection Act 2018 and the UK’s retained sections of the General Data Protection Regulation ((EU) 2016/679)), as amended or updated from time to time and any successor legislation to the UK GDPR or the Data Protection Act 2018;

"Event": the 2026 TCS London Marathon MyWay organised by LMEL;

"Event Date(s)": Sunday 26 April 2026;

"Event Details": the name, image and event completion time of each participant;

“Event Distance”: twenty-six point two (26.2) miles;

"Fee": thirty pounds sterling (£30) or, if you are resident outside of the United Kingdom, forty pounds sterling (£40).

“Finisher Rewards”: has the meaning set out in sub-paragraph 6.1;

“Force Majeure Event”: means any circumstance not within a party's reasonable control including: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic; (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition; (f) collapse of buildings, fire, explosion or accident; (g) solely where LMEL is seeking to rely on paragraph 5, non-performance by suppliers or subcontractors to LMEL or a death of a member of the Royal family; (h) athlete boycott; and (i) interruption or failure of utility service but excluding any labour or trade dispute, strikes, industrial action or lockouts;

"LMEL": London Marathon Events Limited incorporated and registered in England and Wales with number 01528489 whose registered office is at 190 Great Dover Street, London SE1 4YB;

“Mass Event”: means the TCS London Marathon 2026 taking place on the Event Date on a closed-route course of 26.2 miles from Greenwich to Westminster;

“Partners”: any sponsors, suppliers, licensees or partners of the Event from time to time;

“Personal Data”: shall have the meaning given to it in the Data Protection Legislation;

“Privacy Policy”: LMEL’s privacy policy.

“Qualifying Period”: from 00:00 until 23:59:59 GMT on Sunday 26 April 2026;

“Rules”: means the rules and regulations of LMEL relating to the Event, as amended from time to time; and

"you" / "your": means the entrant to the Event.

1.    ENTRY


1.1.    You must be over the age of eighteen (18) to participate in the Event. By submitting your application, you warrant that you will be at least eighteen (18) years of age at the commencement of the Qualifying Period on the Event Date.
1.2.    By submitting your application, you agree to:
1.2.1.    enter the Event;
1.2.2.    pay the Fee to LMEL. For the avoidance of doubt, if you are being provided with an entry to the Event by a Charity, then you do not have to pay the Fee;
1.2.3.    participate in the Event on the Event Date;
1.2.4.    comply with the terms and conditions of the Agreement;
1.2.5.    abide by the Rules; 
1.2.6.    the use of the Event Details and all other data and images that you provide to LMEL in accordance with the Privacy Policy; and
1.2.7.    comply with the terms of use of the App if you choose to use the App to record your participation in the Event.
1.3.    For the avoidance of doubt, acceptance by LMEL of your application to participate in Event does not authorise you or otherwise provide you with any right to participate in the Mass Event.


2.    EVENT SAFETY


2.1.    At all times during the Event you must adhere to all instructions given by LMEL from time to time.
2.2.    Participation in the Event is personal to you. You are strictly prohibited from swapping, selling or transferring, or offering to sell, swap or transfer your place in the Event to any other person. Any breach of this paragraph 2.2 shall render your entry void with no right to a refund and all rights conferred or evidenced by such entry shall be nullified. If you are found to be in breach of this paragraph 2.2 we reserve the right to exclude you from participation in future LMEL events.
2.3.    You are not permitted to use the following items in the Event:
2.3.1.    subject to paragraph 2.5, any wheeled device, except for a self-propelled wheelchair;
2.3.2.    any artificial aid;
2.3.3.    any pets or animals; and
2.3.4.    any other item that could potentially inhibit the safety of other participants or which LMEL, in its reasonable opinion, deem may cause danger or risk of danger to you, a member of the public, or other participants.
2.4.    You warrant to LMEL that, on the Event Date, you will: 
2.4.1.    only participate in the Event if you are sufficiently fit and healthy, and are not injured or otherwise suffering from illness. If you are in any doubt, LMEL recommends that you seek medical advice prior to participating in the Event;
2.4.2.    not have consumed any alcohol or taken any drugs; and
2.4.3.    participate in the Event unaided and in accordance with the Agreement.

2.5.    If you are using a self-propelled wheelchair, it must be without gears or any mechanical, powered, or electronic, aid or device. 
2.6.    All participants must complete the Event Distance to be eligible for Finisher Rewards.
2.7.    Subject to paragraph 2.9.1, you are responsible for selecting the route that you will use for your participation in the Event and the completion of the Event Distance. LMEL shall not be liable for any injury, damage or loss you suffer as a result of your route selection.
2.8.    You are responsible for adhering with all applicable local laws, regulations, codes and/or governmental ordinance and guidelines during your participation in the Event including, but not limited to, any laws or guidelines relating to regional, national and/or tiered lockdowns and social distancing.
2.9.    You acknowledge and accept that: 
2.9.1.    for operational, safety and security reasons, you are prohibited from using a route which is materially the same as, whether in whole or in part, the route of the Mass Event;
2.9.2.    the Event is not a closed road event;
2.9.3.    LMEL is not providing, and shall not be obliged to provide, any marshals for Event; and
2.9.4.        you must adhere with the highway code (details of which can be found at https://www.gov.uk/browse/driving/highway-code-road-safety).
2.10.    If you are participating in the Event during night-time hours or where visibility is severely impacted by for any reason, including without limitation due to the weather or the time of day, LMEL recommends you wear high visibility reflective clothing and an appropriate head torch for the conditions.  LMEL shall not be responsible for any injury, damage or other loss resulting from your decision to participate in the Event during such conditions.


3.    EVENT DISQUALIFICATION


3.1.    LMEL reserves the right to refuse or otherwise reject your entry to the Event or to ask you to cease participation if:
3.1.1.    you fail to follow instructions given by LMEL;
3.1.2.    you are in breach of the Agreement; 
3.1.3.    you attempt to participate in the Event in a manner that LMEL, acting reasonably, believes:
a)    may cause injury to yourself or any third-party, including without limitation another participant;
b)    may damage or harm the environment;
c)    is likely to cause offence; or
d)    otherwise causes a risk or potential risk to health and safety including, without limitation, any failure, in whole or in part, to comply with the restrictions in paragraph 2 above.
3.2.    You will have your results in the Event annulled and be banned from all future events organised by LMEL for a period of up to five (5) years if you:
3.2.1.    sell or otherwise transfer your entry to the Event;
3.2.2.    falsify information on the entry form; or
3.2.3.    materially breach the Agreement, including without limitation a breach of any of the terms and conditions in paragraph 2 of these Conditions of Entry.
3.2.4.    A second breach of the Agreement of any nature may result in your Event results being annulled and a lifetime ban being imposed on you from all future LMEL events. The decision of LMEL in relation to any disqualifications and bans will be final.
3.3.    It is strictly forbidden at the Event to express, to disseminate of any insulting, racist, xenophobic, sexist, religious, political or other illegal/prohibited messages, particularly discriminatory propaganda messages or being in possession of such material.

4.    CANCELLATION BY YOU


4.1.    If you need to withdraw from the Event for any reason the Fee will not be refunded to you or the Charity.

5.    CANCELLATION BY US


5.1.    LMEL may cancel the Event should a Force Majeure Event prevent it from holding the Event.
5.2.    LMEL may also cancel your entry if you have obtained it through a third party that:
5.2.1.    is not entitled to that entry or is otherwise an unauthorised third party; or
5.2.2.    is an authorised third party (such as Charity) that informs us that they no longer wish for you to have the entry.
5.3.    In circumstances where LMEL exercises its right to cancel the Event or your entry in accordance with this paragraph 5, LMEL will, if practicable, provide written notice of cancellation to the address it holds for you. Where written notice is not practicable due to the timescales involved LMEL will use its reasonable endeavours to provide notice using other suitable methods, including without limitation, e-mail, mobile phone, text message, television and radio broadcasts.
5.4.    Where the Event is cancelled, LMEL will:
5.4.1.    process a refund of the Fee only; and
5.4.2.    have no responsibility other than refunding the Fee, for any losses, expenses or costs incurred as a result of, whether directly or indirectly, the cancellation, including without limitation, any travel or accommodation costs. For the avoidance of doubt, any voluntary donation made to a Charity or other third party by you will not be refunded to you under any circumstances.

6.    COMPLETION OF THE EVENT


6.1.    Where you complete the Event Distance for the Event within the Qualifying Period on the Event Date then you shall be eligible for a completion certificate, finisher medal and finisher t-shirt (“Finisher Rewards”) which will be sent to you by post by LMEL.
6.2.    If you choose to use the App to record your participation in the Event, it shall automatically track the distance you have run and will be used as evidence of your completion of the Event Distance. In these circumstances, if the App does not indicate that you have completed the Event Distance within the Qualifying Period, then you shall not be entitled to receive any of the Finisher Rewards.

7.    PRIVACY AND DATA PROTECTION


7.1.    Please read the Privacy Policy carefully to understand how LMEL’s collects and processes your Personal Data. By registering for the Event, you accept and acknowledge the contents of the Privacy Policy. Please see here for our Privacy Policy.  For the avoidance of doubt:
7.1.1.    the Privacy Policy is applicable irrespective of how you obtained your entry to the Event, including if you obtained your entry through a third party, including but not limited to a Charity; and
7.1.2.    where you have obtained your entry to the Event through a third party, including but not limited to a Charity, such third party may also have access to your Personal Data, the collection and processing of which will be subject to the respective privacy policy of that third party.
7.2.    You agree that any audio, visual, or audio-visual recordings that you make of the Event or any part of it are for personal use only and cannot be used for any commercial purpose.

8.    CHANGES TO THE EVENT


8.1.    We reserve the right to make any amendments to the Event that we deem necessary.  Any material change to the Event will be communicated to you on the Event Date, or sooner if practicable.
8.2.    Should any amendments be made to the Event, including but not limited to, a reduction of the Event Distance, you agree and acknowledge that the Event is still deemed to be staged and that we will not be liable to you for any refund of the Fee.

9.    LIABILITY


9.1.    Other than is stated in paragraph 5, LMEL shall not be liable for any refund, loss (including indirect or consequential loss), damage or expense caused by a Force Majeure Event.
9.2.    Subject to paragraph 9.5, in the event that LMEL is in breach of its obligations (under these Conditions of Entry or otherwise), LMEL shall only be responsible for such loss or damage suffered by you which was reasonably foreseeable as a result of the breach. LMEL shall not be responsible for any loss or damage that is not reasonably foreseeable or contemplated at the time you entered into a contract pursuant to these Conditions of Entry.
9.3.    Subject to paragraph 9.5 and notwithstanding paragraph 9.2, LMEL is not liable for any business losses and LMEL will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9.4.    Subject to paragraph 9.5, in any event, to the maximum extent permitted by law, LMEL hereby excludes any liability for loss, damage or injury to you and/or your property, including any indirect or consequential loss or damage, including loss of enjoyment or travel or accommodation costs, regardless of whether the loss or damage: (a) would arise in the ordinary course of events; (b) is reasonably foreseeable; or (c) is in the contemplation of the parties, or otherwise.
9.5.    Notwithstanding any provision in these Conditions of Entry, LMEL does not seek to exclude or limit its liability: (a) for fraud or fraudulent misrepresentation; (b) for death or personal injury caused by LMEL’s negligence or the negligence of any of its officers, employees or agents; or (c) for any other matter for which it is not possible to exclude or limit liability by Applicable Laws (including your statutory rights and rights as a consumer).
9.6.    As the Event is a virtual event, LMEL is not responsible for: 
9.6.1.    selecting a route or course, or ensuring the safety of the course or route;
9.6.2.    providing marshals for the course or route; or
9.7.    providing any equipment (save for the App) necessary for your participation in the Event.

10.    SEVERABILITY AND AMENDMENT


10.1.    LMEL reserves the right to change these Conditions of Entry if necessary to ensure proper and safe staging of the Event. LMEL will notify you of any material changes via an email sent to the address indicated by you in the application and you will have the choice to consent to such material changes or to withdraw your application or withdraw from the agreement concluded with LMEL in accordance with these Conditions of Entry (as applicable).
10.2.    Should any provisions of these Conditions of Entry be declared void, ineffective, illegal or unenforceable by any competent court, regulator or authority, the remainder of these Conditions of Entry shall remain in effect as if such void, ineffective, illegal or unenforceable provision(s) had not been included.


11.    GENERAL


11.1.    If there is a conflict or inconsistency between any term in these Conditions of Entry and any term contained in the other relevant terms and conditions, except where provided to the contrary in the latter, these Conditions of Entry prevail to the extent of the conflict or inconsistency.
11.2.    The Agreement constitutes the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to the Agreement which is not already set out in the Agreement.
11.3.    The Agreement shall be governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts to settle any dispute arising under or in connection with the Agreement. Notwithstanding the foregoing: (a) these Conditions shall not affect a person’s statutory rights as a consumer and , in particular, if the claimant lives in Scotland they can bring legal proceedings in either the Scottish or the English courts or if they live in Northern Ireland, they can bring legal proceedings in either the Northern Irish or the English courts; and (b) LMEL reserves the right to pursue legal proceedings in a competent court of Your domicile, where such proceedings shall be governed and interpreted in accordance with English law.
11.4.    Any person not a party to the Agreement shall have no rights under the Contracts (Rights of Third Parties) Act 1999.
11.5.    Any breach of this Agreement shall render your entry void. If you are found to be in breach of this Agreement, we reserve the right to exclude you from participation in future events.
